Definitions
The terms used in the Regulations mean:
- Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, which places an Order within the Store;
- Consumer – A customer who is a natural person and meets the criteria specified in the definition of art. 22[1] of the Civil Code. According to this definition, a consumer is a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- Entrepreneur with Consumer Rights – a Customer who is a natural person concluding a Sales Agreement directly related to his/her business activity, when the content of the Sales Agreement indicates that it is not of a professional nature for this Entrepreneur, resulting in particular from the subject of the business activity performed by him/her, made available under the provisions on the Central Register and Information on Business Activity.
- Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
- Regulations – these Regulations for the provision of services by electronic means within the online store saintby.pl;
- Online Store (Store) – online service available at https://saintby.pl, through which the Customer may, in particular, place Orders;
- Goods – products presented in the Online Store;

Sales agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between Saintby Anna Baj, ul. Celownicza 4/130, 04-175 Warsaw, NIP 8212086387, entered into the Central Register and Information on Business Activity
The Republic of Poland, run by the Minister responsible for the economy, and the Customer, concluded using the online service of the Store; - Consumer Rights Act – Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827);
- Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
- Order – a declaration of will of the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.
General provisions
- These Regulations define the rules of using the online store available at: https://saintby.pl and are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
- The online store, operating at: https://saintby.pl, is run by Saintby Anna Baj, ul. Celownicza 4/130, 04-175 Warsaw, NIP 8212086387 .
- These Regulations specify in particular:
- Using the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
- In accordance with applicable law, SaintBy Anna Baj reserves the right to limit the provision of services via the Online Store to persons who are over the age of 18. In such a case, potential Customers will be notified of the above.
- Customers can access these Regulations at any time via the link on the home page of the saintby.pl website, save their content, and print it out.
Rules for using the Online Store
In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent over the Internet.
The customer is obliged to:
- not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
- using the online store in a way that does not disrupt its functioning, in particular through the use of specific software or devices,
- use the online store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.
Procedure for concluding a Sales Agreement
- Information about the Goods provided on the Store's websites, in particular their descriptions, technical and operational parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
- In order to conclude a Sales Agreement via the Online Store, go to the website https://saintby.pl, select the product and its color from the Store's offer, taking subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
- The selection of Goods ordered by the Customer is made by adding them to the shopping cart.
- During the Order placement process – until clicking the button “I order with an obligation to pay” or another one that provides equivalent information about the obligation to pay, e.g. “I order and pay – the Customer has the option to modify the entered data and the selected Goods. To do this, the Customer should follow the messages displayed to the Customer and the information available on the website.
- After the Customer using the online store has provided all the necessary data, a summary of the placed order will be displayed. The order summary will contain information about the amount, the amount of any discount, the price of delivery or its absence in the case of an order over PLN 500.
- In order to send an Order, it is necessary to provide personal data marked as mandatory and click the button "I order with an obligation to pay" or another button that clearly informs about the obligation to pay, e.g. "I order and pay".
- Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with SaintBy Anna Baj, in accordance with the Regulations.
- After placing the Order, the Customer receives an e-mail entitled "SaintBy.pl - You have placed order no.", containing the final confirmation of all essential elements of the Order.
- The Agreement is deemed to have been concluded upon receipt by the Customer of the e-mail message referred to above.
- The Agreement is concluded in Polish. The recording, securing and sharing of the Order data and general terms and conditions (Online Store Regulations) is done via e-mail.
Delivery
- Delivery of Goods is not limited to the territory of the Republic of Poland and takes place to the address indicated by the Customer when placing the Order.
- Delivery of the ordered Goods is carried out by DPD, InPost Kurier and InPost Paczkomaty courier. Delivery costs range from PLN 15 to PLN 72 depending on the selected form of delivery and payment. Delivery costs will also be indicated at the time of placing the Order.
- The delivery time is from 1 to 7 business days from the date of sending the Order by the Customer.
Prices and payment methods
- The prices of the Goods are given in Polish zloty and include all components, including VAT.
- The customer can pay for the ordered goods via the external payment system imoje , operated by ING Bank Śląski SA with its registered office in Katowice, including bank transfers, Visa, Mastercard payment cards, wallets such as Apple Pay and Google Pay. Additionally, via the PayPal online payment system.
Right to withdraw from the contract
- A Customer who is a Consumer has a 14-day period to withdraw from the contract. The Consumer has the right to withdraw from this contract within 14 days without giving any reason. The period to withdraw from the contract expires after 14 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item.
- The Buyer (Consumer and Entrepreneur with Consumer rights) has the right to withdraw from the concluded contract in writing without giving any reason within 14 (in words: fourteen) days from the date of conclusion of the contract pursuant to the Act of 30 May 2014 (Journal of Laws of 2014, item 827, as amended). In the event of a written withdrawal from the contract, the Customer is obliged to return the goods within 14 (in words: fourteen) days.
- The right referred to above also applies to a natural person – an Entrepreneur with the rights of a Consumer, concluding an agreement directly related to his/her business activity, when it results from the content of this agreement that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Register and Information on Business Activity.
- To exercise the right to withdraw from the contract, you must inform us Saintby Anna Baj, ul. Celownicza 4/130, 04-175 Warsaw, NIP 8212086387, tel. 733 160 400 e-mail: [email protected] of your decision to withdraw from this contract by means of an unequivocal statement, by sending such information to the e-mail address provided or by using the account set up in the Automatic Returns Service.
- You can use the model withdrawal form, but this is not obligatory. You can also fill in and submit the withdrawal form or any other clear statement electronically on our website https://saintby.pl. If you use this option, we will immediately send you confirmation of receipt of the information about withdrawal from the contract on a durable medium (e.g. by e-mail).
- In order to meet the withdrawal deadline, it is sufficient for you to send information regarding the exercise of your right to withdraw from the contract before the withdrawal deadline expires.
Consequences of withdrawal from the contract
- If you withdraw from this contract, we will refund all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us). The refund procedure can be initiated on the first business day after Saintby Anna Baj receives the returned items.
- Saintby will refund the funds within 14 days of the day we received the returned goods. We will make the refund using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise.
- In the event of exercising the right to withdraw from the contract within 14 days, the shipping costs for returning the goods shall be borne by the buyer.
Complaints about Goods
- SaintBy Anna Baj, as the seller, is liable to the Customer who is a Consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and Art. 556[1] – 556[3] and subsequent Art. of the Civil Code.
- SaintBy Anna Baj shall be liable to the Consumer and the Entrepreneur under the rights of the Consumer for the lack of conformity of the Goods with the sales contract existing at the time of its delivery and revealed within two years from the date of issue or expiry of the minimum durability of the Goods.
- SaintBy Anna Baj is liable to the Consumer and the Entrepreneur under the rights of the Consumer in this respect under the principles specified in the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2022, item 2337).
- A complaint may be submitted by a Consumer or an Entrepreneur with Consumer rights to the address [email protected]. The Seller undertakes to consider each complaint within 14 days.
Complaints regarding the provision of services by electronic means
- The online store takes steps to ensure that the store's website and pages operate correctly to the extent that results from current technical knowledge and undertakes to remove any technical irregularities reported by Customers within a reasonable time.
- The Customer may report any irregularities related to the operation of the website and the store’s websites in writing to the following address: Saintby Anna Baj, ul. Celownicza 4/130, 04-175 Warsaw, NIP 8212086387 , or by e-mail to [email protected].
- In the complaint, the Customer should describe the type and date of the irregularity related to the operation of the Store.
Dispute Resolution and Final Provisions
- A customer who is a consumer may, if interested, use out-of-court methods of handling complaints and pursuing claims. Disputes concerning online purchases can be resolved through mediation proceedings before the Voivodeship Inspectorates of Trade Inspection or a trial before an arbitration court at the Voivodeship Inspectorate of Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and, for example, submit their complaint via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/
- In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means and other relevant provisions of Polish law shall apply.
